This Privacy Policy describes how Joe Gibbs Racing and its affiliates (collectively, “JGR”, “we”, “us”, or “our”) collect, use, and disclose your personal information when you access, use, make a purchase from or otherwise communicate with us through our websites, software applications, social media pages, e-mail messages, text messages, or other digital services (including both mobile and online applications for each, collectively, “Digital Services”). For purposes of this Privacy Policy, “you” and “your” means you as the user of the Digital Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.


Please read this Privacy Policy carefully. By accessing any of the Digital Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the Digital Services.


Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons without prior notice. We will post the updated Privacy Policy on the Digital Services and take any other steps required by applicable law. We encourage you to review this Privacy Policy periodically and to make note of the date of the most recent revision. Your continued use of the Digital Services following the posting of an updated Privacy Policy means you accept these changes.


How We Collect and Use Your Personal Information

We collect personal information about you from a variety of sources. The information that we collect and use varies depending on how you interact with us. In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide goods and services to you, market to you, comply with any applicable legal obligations, enforce any applicable terms of service, and protect or defend the Digital Services, our rights, and the rights of our users or others.


What Personal Information We Collect

The types of personal information we obtain about you depends on how you interact with us and use the Digital Services. When we use the term “personal information”, we are referring to information that identifies, relates to, describes or can be associated or linked with you. The following sections describe the categories and specific types of personal information we collect.


Information We Collect Directly from You

Information that you directly submit to us through the Digital Services such as when you register, communicate, or transact business with us, which may include:

  • Contact and demographic information including your name, address, phone number, email address, age, gender.

  • Order information including your name, billing address, shipping address, payment information (e.g., bank account, credit or debit card information), payment confirmation, email address, phone number.

  • Account information including your username, password, security questions.

  • Shopping information including the items you view, put in your cart or add to your wishlist.

  • Customer support information including the information you choose to include in communications with us, for example, when sending a message through the Digital Services.


Some features of the Digital Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features.


Information We Collect through Cookies

We automatically collect certain information about your interaction with the Digital Services (“Usage Data”) by using online tracking technologies such as cookies, pixels, web beacons, software developer kits, third-party libraries, or other similar technologies (collectively, “Cookies”). Usage Data may include information about how you access and use the Digital Services and your device information, browser type, version and time zone setting, browser plug-in types and versions, operating system, information about your network connection, IP address, login credentials, and other information regarding your interaction with the Digital Services.


Information We Obtain from Third Parties

We may obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf, such as:

 

  • Companies who support our Digital Services, including, without limitation, our online Team Store.

  • Payment processors who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested.

  • When you access the Digital Services, open or click on emails we send you, or interact with our services or advertisements, we, or third parties we work with, may automatically collect certain information using Cookies.


Any information we obtain from third parties will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party’s policies or practices. How We Use Your Personal Information

  • Providing Products and Services. We use your personal information to provide you with products and services, including to process your payments, fulfill your orders, send notifications to you related to your account, purchases, returns, exchanges or other transactions, create, maintain and otherwise manage your account, arrange for shipping, facilitate any returns and exchanges and enable you to post reviews.

  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, including, without limitation, to send marketing, advertising and promotional communications to you by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Digital Services to you by creating and publishing content and advertising most relevant to you based on your interaction with the Digital Services,.

  • Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Digital Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.

  • Communicating With You. We use your personal information to provide you with customer support and improve our Digital Services so that we can be responsive to you, provide the products and services you request, and maintain our business relationship with you. We may also use your personal information to send you information, newsletters, educational materials, and JGR team updates.


Cookies

As noted above, we use Cookies on the Digital Services, including our websites. We use Cookies to power and improve the Digital Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Digital Services (in our legitimate interests to administer, improve and optimize the Digital Services), and for advertising purposes. We may also permit third parties and service providers to use Cookies on the Digital Services to better tailor the products, services and advertising on the Digital Services. When you interact with the Digital Services, advertisements may be displayed to you based upon information such as purchasing or browsing behaviors on the Digital Services. 


These tracking technologies enable us to identify the ads you see, whether you click on them, and other actions you take on our sites, so that we can tailor advertising, including for example avoiding repetition of ad content. We do not use personal information, such as name or contact details, to tailor advertising. For example, if you visit our website, your visit may be recorded in a cookie which may result in your seeing a targeted ad when you visit a different website. Some media buying platforms such as Facebook enable us to use personal information such as email addresses, and we take steps to honor the privacy restrictions imposed by those platforms.


We may use advertisers, third party ad networks, and other advertising companies, to serve advertisements on the site. Please be advised that such advertising companies may gather information about your visit to the site or other sites (such as through cookies, web beacons and other technologies) to enable such advertising companies to market products or services to you, to monitor which ads have been served to your browser and which webpages you were viewing when such ads were delivered. These advertisers may read and place cookies on our site, but they do not have access to personal information such as name or contact details.


The Digital Services, whether accessed on a computer or a mobile device, are not at this time configured to read or respond to “do not track” settings or signals in your browser headings, which vary by browser provider. In lieu of a browser-based opt-out solution, users can utilize the digital advertising alliance and other approved methods for placement of opt-out cookies. Our website and those of our third party advertisers or other vendors are configured to read and honor these opt-out cookies, so long as they are present on your computer.


There are four main types of cookies – here’s how and why we use them.


(1) Site functionality cookies – these cookies allow you to navigate the site and use our features, such as “add to cart”.

(2) Site analytics cookies – these cookies allow us to measure and analyze how our customers use the site, to improve both its functionality and your shopping experience.

By using our site, you agree to us placing these sorts of cookies on your device and accessing them when you visit the site in the future. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate business purposes subject to this Privacy Policy, including, without limitation:

  • With third-party service providers, agents or independent contractors who perform services on our behalf (e.g., management and maintenance of the Digital Services, fraud detection and customer verification, payment processing, data analytics, customer service, cloud storage, order processing, fulfillment and shipping, sending customer communications on our behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes and other promotions). 

  • With business and marketing partners to provide products and services and advertise to you.  Our business and marketing partners will use your information in accordance with their own privacy policies.

  • When you direct, request or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations, with your consent.

  • With third parties to track and analyze non-identifying and aggregate usage and volume statistical information from our Digital Services visitors and customers.

  • With our affiliates, agents or otherwise within our corporate group, for research, administrative and/or internal business purposes.

  • With third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

  • To comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service, and to protect or defend the Digital Services, our rights, and the rights of our users or others.


We have, in the past 12 months disclosed the following categories of personal information and sensitive personal information (denoted by *) about users for the purposes set out above in “How we Collect and Use your Personal Information” and “How we Disclose Personal Information”:

We do not use or disclose sensitive personal information for the purposes of inferring characteristics about you. 


User-Generated Content

The Digital Services may enable you to post reviews and other user-generated content. If you choose to submit user-generated content to any public area of the Digital Services, this content will be public and accessible by anyone. We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.


Third Party Websites and Links

The Digital Services may provide links to websites or other online platforms operated by third parties. These links are made available to you as a convenience, and you agree to use these links at your own risk. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Digital Services and/or users of those third-party platforms without limitation as to its use by us or by a third party.  Use of third-party social networking websites, such as Facebook, Instagram, TikTok, LinkedIn, etc., are governed by the privacy policies and practices of those websites. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as explicitly disclosed on the Digital Services.


Children’s Data

The features, programs, promotions and other aspects of the Digital Services requiring personally identifiable information are not intended to be used by children, and we do not knowingly collect any personally identifiable information about children. If you are the parent or guardian of a child who you believe has disclosed their personally identifiable information to us, you may contact us at customerservice@joegibbsracing.com to request deletion of such child's personally identifiable information as well as prohibit the use thereof. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.


Security and Retention of Your Information

No data transmissions over the internet can be guaranteed to be 100% secure, no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit, and any information that you transfer to us is done at your own risk. We work to protect the security of your information during transmission by using secure sockets layer (ssl) software, which encrypts information you input. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us. How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide any requested products or services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.


Opt-Out of Communications

We may send you promotional emails or text messages, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails or in our text messages to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.


We will process your request as soon as possible in accordance with applicable law, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe request is processed. Please note that we may still send you important administrative messages even if you opt-out of receiving marketing communications. Additionally, we may send you information regarding our services, such as information about changes to our policies and other notices and disclosures required by law. Generally, users cannot opt-out of these communications, but they will be primarily informational in nature, rather than promotional.


Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

 

  • Right to Access / Know. You may have a right to request access to personal information that we have collected about you, including details relating to the ways in which we use and share your information, and a right to know and request that we disclose certain information to you about our collection and use of your personal information.

  • Right to Delete. You may have a right to request that we delete some, but not all, of your personal information.  We may retain certain categories of personal information for numerous purposes including, without limitation, (i) to complete a transaction; (ii) to perform a contract between you and us; (iii) to comply with a legal obligation, such as a record retention requirement, under applicable laws; and (iv) other internal and lawful purposes.

  • Right to Correct. You may have the right to request that we correct inaccurate personal information that we maintain about you.

  • Restriction/Opt-Out of Processing: You may have the right to ask us to stop or restrict our processing, disclosure or sale of your personal information.

  • Withdrawal of Consent: Where we rely on consent to process your personal information, you may have the right to withdraw this consent.


You may exercise any of these rights where indicated on the Digital Services or by contacting us using the contact details provided below. We will not discriminate against you for exercising or attempting to exercise any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

If you are not satisfied with our response to your complaint, depending on where you live you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority.


Notice to International Residents

We are based in the United States. Personal information may be accessed by us or transferred to us in the United States or to our affiliates, business partners, or service providers elsewhere in the world. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States. We will protect the privacy and security of personal information according to this Privacy Policy regardless of where it is processed or stored.
